2. Membership subscription
Subscription of the Xun Art Gallery membership gives you access to the Xun Art Gallery shop and content only available to members. A membership gives you also access to the purchase of artworks before they are made public on our website.
The membership fee is 80EUR per year. You will receive a reduction coupon of the value of the membership upon subscription of a membership. This coupon can used to get a reduction for the purchase of one artwork.
A membership subscription is not refundable.
Your membership is personal and it shall not be transferred to another person.
We do not automatically renew the membership subscription at the anniversary date. You will be automatically informed when your membership period reaches the end of the annual period.
3. Pricing and payment
The cost of your order reflects the price of the items ordered including the shipping charge for handling, packing and postage. By default all products are priced in EURO (€), all tax excluded. Applicable custom tax and/or import tax applicable in the country of shipping delivery are at the charge of the buyer.
For purchase of items localized in Luxembourg and for which the billing address is in the EEA, the VAT rate of Luxembourg (17%) will be applied to the purchase price.

We primarily accept payment that are available and mentioned in our online shop. Another payment method can be accepted upon agreement with Xun Art Gallery.
4. Estimated shipping times
The shipping time depends on the location of the ordered item and the shipping destination.
If the item is located in Luxembourg, the following estimated shipping times apply:
– Europe: 15 days
– Rest of World: 1 month
If the item is located in China, the following estimated shipping times apply:
– China: 15 days
– Rest of World: 1 month
Your order will be delivered to the delivery address you supply. All delivery times quoted above are estimates only, based on availability, processing and postage time. Shipment is performed with a tracking possibility.
5. Order acknowledgment
When you have completed your order you will be redirected to an order confirmation page. This page will detail the product(s), the cost (including postage and packaging) and delivery specifications. Please inform us immediately if you notice any errors on the order. You will also be sent an acknowledgment email confirming that the order is being processed.
6. Contract
A legally binding contract between you and us will be formed when we email you to confirm that your order has been accepted and that we have shipped the goods to you. This email represents our acceptance of the offer you made to purchase the goods when you completed your order. If we confirm to you that some but not other products that you have ordered have been shipped, those goods that have not been shipped will not form part of our contract with you. In the event of any change between completion of your order and contract formation, we will inform you and you will at that point have the right either to accept the change (in which case your email reply will represent a new offer, which we will accept upon notification of shipment) or reject the change (in which case your email reply will represent a withdrawal of your order, or the relevant part of your order as the case may be).
7. Returns policy
In the case that the goods are faulty, damaged or incorrectly supplied, please contact us within seven working days and we will ask you to return the goods to the following address:

For sculptures that have a size over 1 meter (height or length), please contact us in order to arrange the return.
We recommend that you use registered post or recorded delivery to return goods to us as we cannot be responsible for non-delivery of returned items. We will refund postage costs incurred in returning faulty, damaged or wrongly supplied goods. We shall use reasonable efforts to replace damaged or incorrect goods, but if replacement is not possible, or if an order is cancelled for any other reason, we will only be obliged to refund the full amount paid by you. This does not affect your statutory rights.
8. Cancellations
You may cancel an order within 24 hours of the order being made and paid for. Thereafter, should you wish to cancel the order, it must be returned by you in perfect condition within 7 days of delivery (please see Returns policy above).

10. Company Information
XUNARTGALLERY is a fine art gallery registered in Luxembourg. The proprietor is Yan ‘Joyce’ XUN. All correspondence should be sent to the head office address. XUN ART GALLERY 18, Rue de Neuerburg, L-2215 LUXEMBOURG and/or Yan XUN shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.
11. Copyright
The material and content contained within the website is made available for your personal non-commercial use only. Any other use of the material and content of the website is strictly prohibited. By accessing our website you agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content. We will also include a warranty certificate signed by the painter.
12. Limitation of Liability
Although we take every care to ensure accuracy, we make no warranties as to the accuracy of the information we place on our web pages. The extent of our liability for any breach of these terms and conditions shall be limited to the value of the goods ordered by you in the relevant transaction.
13. Invalidity of Terms and Conditions
If for any reason part of these terms and conditions is unenforceable; the validity of the remaining terms and conditions shall not be affected. These terms and condition are governed and shall be interpreted in accordance with the Laws of Luxembourg.
